Social Security Laws
On January 5, 2025, The Social Security Fairness Act, which repealed the Windfall Elimination Provision ("WEP") the Government Pension Offset ("GPO") provisions of Social Security was signed into law. This law has a retroactive effective date of January 1, 2024, which means that the Social Security Administration ("SSA") will be required to recalculate benefits for anyone affected by this statute during 2024. While this matter is not specific to Massachusetts public retirement boards, this question commonly arises during the retirement process for members of the Essex Regional Retirement System ("ERRS"). ERRS recommends that members contact their local Social Security Administration office for more information on this important change.
