Homestead Act forms can be filed at the Registry of Deeds
Protect your home from being taken in a lawsuit
You must apply for homestead protection in Massachusetts. The Massachusetts Homestead Law protects your home in the event of a lawsuit and against the claims of creditors by protecting the property from execution and forced sale, so long as such person occupies or intends to occupy such property as his or her principal place of residence. You are still responsible for your mortgage and taxes. No other creditor can go after your home. The fee is $35 and the form is available at the Registry of Deeds website listed below.
